These Terms of Service (“Terms”) govern your use of our website, forms, communications, and services offered by Gracie Barra Nadd Al Hamar (the “Academy”, “we”, “us”, “our”) in Dubai, United Arab Emirates (UAE).

By submitting a form, booking a trial, purchasing a membership, or attending classes/events, you agree to these Terms. If you do not agree, do not use our services.

2) Services

We provide Brazilian Jiu-Jitsu training and related services, which may include trial classes, group classes, private classes, seminars, events, membership plans, and merchandise (if applicable).

We may change class formats, schedules, instructors, and offerings when reasonably necessary (for example, for safety, staffing, facility needs, or special events).

3) Eligibility and minors

  • You must be 18+ to register and contract in your own name.
  • For minors, a parent/legal guardian must register the minor, accept these Terms, and sign any required waivers/consents on the minor’s behalf.

4) Health, safety, and assumption of risk

Martial arts training involves inherent risks (including sprains, strains, fractures, concussion, or other injuries). By attending, you:

  • Confirm you are physically able to participate and will stop if you feel unwell or unsafe.
  • Agree to follow instructor directions and Academy rules.
  • Acknowledge you train at your own risk.

Medical disclaimer: We do not provide medical advice. Consult a physician before starting any new physical activity program.

Waivers and forms: You may be required to sign additional liability waivers, medical forms, and conduct policies as a condition of participation.

5) Trials, bookings, and attendance

  • Trials may require advance booking. Availability is limited.
  • If you cannot attend, please reschedule as early as possible. We may limit repeated no-shows or last-minute cancellations.
  • For safety reasons, we may deny entry if you arrive late beyond a reasonable threshold.

6) Memberships, fees, and payments

6.1 Pricing and inclusions

Membership fees, joining fees (if any), taxes/VAT (if applicable), and what is included in your plan will be displayed or communicated to you before purchase.

6.2 Recurring billing / auto-renewal

If your plan includes recurring billing, you authorize us (or our payment provider) to charge applicable fees according to your selected plan and billing frequency. We will disclose: plan type, billing frequency, start date, and whether the plan auto-renews.

6.3 Failed payments

If a payment fails, we may re-attempt the charge within a reasonable time and/or suspend access until payment is made.

6.4 Receipts and records

We provide receipts/invoices where applicable and maintain transaction records consistent with UAE consumer protection requirements.

7) Cancellations, freezes, and refunds

IMPORTANT: You must complete this section to match your actual business policy, and apply it consistently.

7.1 Cancellation

To cancel a membership, you must submit a request by email to gbdubainadalhamar@gmail.com or in person at the Academy. Notice period: [INSERT]. Effective cancellation date: [EXPLAIN HOW CALCULATED].

7.2 Freeze (pause)

Freeze requests may be allowed for travel or medical reasons: minimum freeze length [INSERT], maximum [INSERT], documentation required [YES/NO].

7.3 Refunds

Refund eligibility depends on what you purchased and what has been used (trial, monthly, term plan, merchandise). We do not exclude any mandatory rights that consumers may have under applicable UAE consumer protection laws.

8) Academy rules and conduct

  • Respect instructors, staff, and other members.
  • Follow hygiene requirements (clean uniform, trimmed nails, etc.).
  • Do not engage in harassment, discrimination, or unsafe behavior.
  • Do not train under the influence of alcohol/drugs.
  • Follow sparring rules and tap/stop signals.

We may suspend or terminate access for serious or repeated violations, subject to applicable law.

9) Personal property

You are responsible for your belongings. To the extent permitted by applicable law, the Academy is not responsible for loss or theft of personal items.

10) Photography, video, and media

We may capture photos/videos during classes or events for training quality, safety review, and internal recordkeeping.

Marketing use: If we use identifiable photos/videos of you for marketing, we will do so only where permitted and, where required, with your consent. You can request not to appear in marketing content by contacting gbdubainadalhamar@gmail.com, and we will take reasonable steps to accommodate in group settings (e.g., avoid close-ups), noting this may not always be possible in every situation.

11) Website and acceptable use

  • Do not submit false information.
  • Do not attempt to disrupt or compromise the website/CRM systems.
  • Do not copy or misuse our content, brand assets, or materials.

12) Intellectual property

Our brand, logos, website content, and training materials are owned by us or our licensors. You may not reproduce or distribute them without written permission.

13) Communications and marketing

Service communications: By providing your phone number/email, you agree we may contact you about your inquiry, trial class, scheduling, reminders, and membership administration.

Marketing communications: Promotional messages will be sent only where permitted and you can opt out at any time (e.g., replying “STOP” or using “unsubscribe”). Telephone marketing is subject to UAE telemarketing regulations applicable to UAE-licensed businesses.

14) Privacy

Our collection and use of personal data is described in our Privacy Policy, in line with the UAE PDPL.

15) Electronic agreements and records

By clicking “submit”, checking a box, signing digitally, or completing an online purchase, you agree that electronic records/signatures may be used to form a valid agreement and may be admissible as evidence, consistent with UAE electronic transactions and trust services rules.

16) Disclaimers

  • We do not guarantee specific results (fitness, self-defense outcomes, competition performance).
  • Instructors may modify training activities based on safety and skill level.
  • Services are provided “as available” and may be impacted by holidays, maintenance, or events.

17) Limitation of liability

To the maximum extent permitted by applicable law, the Academy will not be liable for indirect or consequential damages. Nothing in these Terms limits liability where such limitation is not permitted by law.

18) Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., government actions, extreme weather, facility shutdowns, power/internet outages).
